Pence had asked a judge to reject a lawsuit filed by some Republicans seeking to give him the authority to overturn President-elect Joe Biden’s electoral victory, according to an article from USA Today.
Pence argued in a 14-page filing from Justice Department lawyers that the lawsuit should be brought against Congress, not the office of the vice president. Louie Gohmert, a House Representative and Republican from Texas, along with some other party members, filed the suit arguing the vice president “has the constitutional authority to decide which states’ Electoral College votes to count.”
Judge Jeremy Kernodle, who Trump appointed to the federal bench, ruled that Gohmert and the slate of Republican electors from Arizona did not have legal standing to bring the case, according to the Reuters report.
