Judge Rules Man Legally Dead Despite Him Appearing in Court

An Ohio probate court judge last week refused to reverse a 1994 declaration that Donald Eugene Miller Jr. is legally dead despite the fact that Miller stood, apparently alive, in front of the judge in his courtroom. So NPR reports.

The reason? Ohio has a three-year limitation on rescinding declarations of death. Davis had been declared legally dead by the court 19 years ago after disappearing from his home in 1986. Since then, his children have been receiving Social Security death benefits, which—thanks to the judge's ruling—they will not be required to repay.
