SCOTUS Unlikely to Decide Constitutionality of Prop 8

The U.S. Supreme Court will probably not determine whether Proposition 8 is constitutional, a SCOTUS blog author opines.

The high court will end up doing one of two things instead: (1) dismissing the Prop 8 case that is before the Supreme Court because the justices can’t reach a majority decision; or (2) holding that the petitioners defending Prop 8 in the case before the Supreme Court lack “standing” to appeal. “The upshot of either scenario is a modest step forward for gay rights advocates, but not a dramatic one,” the blogger says.
