The prosecutors pointed out several infractions by the criminal, Nicholas Avitto, when they argued that he should be punished within the sentencing guidelines, which range from 10 to 12 years in prison. Prosecutors further said the depression that Avitto experienced as a result of his young son’s death did “not constitute extraordinary circumstances sufficient to award acceptance (of responsibility) points,” which would reduce the sentencing guidelines.
