If an appeals court affirms Italy’s highest court’s decision last month to reverse its 2011 acquittal of Amanda Know, the American former exchange student, there will likely be major demonstrations of transnational law, according to Alan Dershowitz, who wrote about the issue in the Wall Street Journal.
Transnational law is law applied by the domestic legal system of one nation against citizens of other nations. For example, can Knox—who was acquitted by an appeals court—be extradited despite a treaty between the United States and Italy prohibiting the U.S. from extraditing someone who has been "acquitted," which under American law generally means acquitted by a jury at trial?
